General Terms and Conditions
- Scope of Application
The General Terms and Conditions (hereinafter referred to as "GTC") apply to all legal transactions concluded via the online store www.hearanova.ch (hereinafter referred to as the "Online Store"). The Online Store is operated by Hearanova GmbH (hereinafter referred to as "Hearanova").
Hearanova reserves the right to modify these GTC at any time. The version of the GTC valid at the time of order placement is applicable and cannot be unilaterally changed for that order. Contradictory or deviating terms and conditions of the customer are not recognized.
If individual provisions of these GTC are invalid or ineffective, the validity of the remaining provisions and these GTC as a whole remain unaffected.
The offering of products and services in the Online Store (hereinafter referred to as the "Offer") is exclusively intended for customers with a residential or business address in Switzerland or Liechtenstein.
Deliveries are made exclusively to addresses in Switzerland or Liechtenstein.
The Offer is valid as long as the product is available via the search function in the Online Store and as long as stock lasts.
Orders in non-household quantities may be rejected without justification.
- Conclusion of Contract
The products and prices listed in the Online Store constitute an offer. However, this offer is subject to the condition of possible non-availability or incorrect pricing. The contract is concluded as soon as the customer places an order via the Online Store, in one of the stores, by telephone, or by email (hereinafter referred to as the "Contract").
The receipt of an online order is confirmed to the customer via an automatically generated order confirmation sent to the email address provided. This confirmation does not guarantee that the product can actually be delivered; it merely informs the customer that the order has been received and that the contract is subject to the condition of availability and correct pricing.
- Right of Return
Hearanova grants the right to return ordered products within a maximum of 14 calendar days from receipt. For hearing aids, the return period is 30 days.
Products must be sent via registered mail to the address specified under “Contact” in the Online Store. Products that have been used, removed from their original packaging, or damaged are excluded from the right of return. An exception applies to hearing aids, which may be returned within 30 days of use, provided the original packaging is still intact and returned along with the product.
For hearing aids, the return period is limited to 30 calendar days from receipt. If devices were previously tested and a final order was subsequently placed, the return right applies only in case of dissatisfaction with the hearing aid settings.
- Delivery Conditions
Products available in the Hearanova warehouse are shipped within 3-4 days after payment is received. For all other products, an individual delivery date will be communicated to the customer.
If Hearanova is delayed in delivery, the customer has the right to withdraw from the contract starting from the 30th calendar day after the originally announced delivery date. In such cases, Hearanova will refund any advance payments made by the customer. No further claims against Hearanova exist.
- Duty to Inspect
The customer must immediately check delivered products for accuracy, completeness, and any delivery damages.
Delivery damages, incorrect, or incomplete deliveries must be reported to Hearanova within 5 calendar days from receipt.
- Payment Terms
Payments must be made in Swiss francs (CHF).
Accepted payment methods include online banking, bank or postal transfer, credit card (Mastercard and VISA), and SOFORT transfer.
For credit card payments, the charge is made at the time of order placement.
For advance payments, delivery occurs only after receipt of payment. Products that are not in stock will be ordered only upon receipt of payment.
For purchases on account, the customer must pay the invoice amount within 20 calendar days of receiving the delivery, without any deduction (such as discounts). In the case of partial returns, the invoice amount may be adjusted accordingly.
- Payment Default
If the customer fails to meet payment obligations in full or in part, all outstanding amounts owed to Hearanova become immediately due, and Hearanova may demand payment and suspend further deliveries.
Hearanova charges a processing fee of CHF 30 for the second reminder and CHF 50 for the third reminder.
- Retention of Ownership
Ordered products remain the property of Hearanova until full payment is received.
- Data Protection
Hearanova treats all customer data confidentially and uses it exclusively for internal purposes.
The customer agrees that the postal service may provide Hearanova with the correct address if a shipment could not be delivered to the specified address.
- Warranty
Hearanova provides a two-year warranty from the date of delivery or in-store pickup, ensuring the product is free from defects and functions correctly. Hearanova may fulfill the warranty through:
- Free repair
- Partial or full replacement with an equivalent product (if replaced with a used product, the warranty period is one year)
- Credit at the daily price, up to the maximum sale price at the time of order
- Price reduction
For hearing aid purchases, unlimited remote adjustment sessions are included for six years, subject to fair use.
- Liability and Disclaimer
Liability is governed by applicable legal provisions. However, Hearanova is not liable in any case for:
- Slight negligence
- Indirect and consequential damages, including lost profits
- Unrealized savings
- Damages resulting from delivery delays
- Any actions or omissions of Hearanova’s auxiliary personnel, whether contractual or non-contractual
- Jurisdiction and Applicable Law
All legal relationships between Hearanova and the customer are subject to Swiss substantive law. The Vienna Sales Convention does not apply.
For claims by consumers, the place of jurisdiction is either Baar or their place of residence. In all other cases, Baar is the exclusive place of jurisdiction.
