Terms and Conditions
- Scope of Application
These terms and conditions (hereinafter referred to as "T&Cs") apply to all legal transactions conducted via the online shop at www.hearanova.co.uk (hereinafter referred to as "Online Shop"). The online shop is operated by Clear Hear Solutions Ltd (hereinafter referred to as "Clear Hear Solutions").
Clear Hear Solutions reserves the right to amend these T&Cs at any time. The version of the T&Cs that is valid at the time of placing the order shall apply and cannot be unilaterally altered for that order. Conflicting or deviating terms of the customer will not be recognized.
Should individual provisions of these T&Cs be invalid or unenforceable, this does not affect the validity of the remaining provisions or the T&Cs as a whole.
The offer of products and services in the Online Shop (hereinafter referred to as "Offer") is exclusively intended for customers with a residence or business address in the United Kingdom.
Deliveries are made only to addresses within the United Kingdom.
The offer is valid as long as the product is searchable in the online shop and is in stock. Orders in quantities that are not typical for private households may be rejected without justification.
- Contract Formation
The products and prices in the online shop are considered an offer. This offer is always subject to the condition that the contract may be voided due to delivery impossibility or incorrect pricing. The contract is concluded when the customer places an order via the Online Shop, telephone, or email (hereinafter referred to as "Contract").
The receipt of an online order is confirmed to the customer via an automatically generated order confirmation sent to their provided email address. This order confirmation does not guarantee the availability or delivery of the product but merely indicates that the order has been received and the contract is contingent on delivery feasibility and correct pricing.
- Right of Return
Clear Hear Solutions grants a right of return for ordered products within 14 calendar days of receipt. For hearing aids, the return period is 30 days.
Products must be returned via registered mail to the address specified under "Contact" in the Online Shop. Used, opened, or damaged products are excluded from the right of return. An exception applies to hearing aids, which can be returned even after use within 30 days, provided the original packaging is intact and included.
Hearing aids are eligible for return within 30 calendar days of receipt. If devices were tested before placing the final order, the return right for the final devices applies only in cases of dissatisfaction with hearing aid settings.
Products available in stock are shipped within 3-4 days of payment receipt. For other products, an individual delivery date will be communicated to the customer.
If Clear Hear Solutions is delayed in delivery, customers are entitled to withdraw from the contract after 30 calendar days from the originally announced delivery date. In such cases, Clear Hear Solutions will refund any pre-paid amounts. No further claims can be made against Clear Hear Solutions.
- Inspection Obligation
Customers must inspect delivered products immediately upon receipt for accuracy, completeness, and damage.
Delivery damages, incorrect, or incomplete deliveries must be reported to Clear Hear Solutions within 5 calendar days of receipt.
- Payment Methods
Payments must be made in British Pounds (GBP).
Accepted payment methods include online banking, bank transfer, credit card (Mastercard and Visa), and direct transfer.
For credit card payments, the amount will be charged at the time of ordering.
For advance payments, delivery will occur only after payment has been received. Products not in stock will only be ordered upon receipt of payment.
For purchases on account, customers must pay the invoice amount within 20 calendar days of receiving the delivery without any deductions (eg, discounts). If some products are returned, the invoice amount may be reduced accordingly.
- Payment Default
If the customer fails to meet payment obligations in full or in part, all outstanding amounts owed to Clear Hear Solutions become immediately due, and Clear Hear Solutions may demand payment and suspend further deliveries.
Clear Hear Solutions charges a handling fee of £30 for the second reminder and £50 for the third reminder.
- Retention of Ownership
Ordered products remain the property of Clear Hear Solutions until fully paid. - Data Protection
Clear Hear Solutions treats all customer data confidentially and uses it solely for internal purposes.
The customer agrees that, in the event of an undeliverable address, Royal Mail may provide the correct address details to Clear Hear Solutions.
- Warranty
Clear Hear Solutions provides a warranty for defect-free and functional products for two years from delivery or collection. The warranty may be fulfilled at Clear Hear Solutions' discretion through:
- Free repair,
- Partial or full replacement with an equivalent product (for replacements with used products, the warranty period is one year),
- Credit note for the current market value, up to the maximum sale price at the time of order, or
- Price reduction.
Purchasing a hearing aid includes unlimited remote adjustment sessions for six years, subject to fair usage.
- Liability and Disclaimer
Liability is governed by applicable legal provisions. However, Clear Hear Solutions is not liable for:
- Slight negligence,
- Indirect and consequential damages or lost profits,
- Unrealized savings,
- Delivery delays, or
- Acts and omissions of Clear Hear Solutions' auxiliary persons, whether contractual or non-contractual.
- Jurisdiction and Applicable Law
All legal relationships between Clear Hear Solutions and the customer are governed by UK law. The UN Convention on Contracts for the International Sale of Goods does not apply.
For claims by consumers, the jurisdiction is their place of residence or the headquarters of Clear Hear Solutions. For all other cases, the exclusive jurisdiction is the headquarters of Clear Hear Solutions.
